Wicked Chefs Catering LLC — Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of www.wickedchefs.com and your purchase or use of catering, delivery, staffing, rental, event, and related services provided by Wicked Chefs Catering LLC (“Wicked Chefs,” “we,” “us,” or “our”).
Please read these Terms carefully. By using our website, submitting an order, accepting a proposal, signing an agreement, submitting a deposit or payment after receiving these Terms, or otherwise engaging our services, you agree to be bound by these Terms.
If you do not agree with these Terms, do not submit an order or use our services.
- Incorporated Policies
The following Wicked Chefs policies are incorporated into these Terms:
An event-specific signed agreement, accepted proposal, order confirmation, or approved written change may contain additional terms. If an event-specific document conflicts with these Terms or an incorporated policy, the event-specific document will control for that event.
An invoice controls the prices, taxes, amounts, and payment deadlines shown on that invoice but does not otherwise replace these Terms unless expressly stated.
- Eligibility and Authority
You must be at least 18 years old and legally capable of entering a binding agreement to place an order or reserve services.
If you accept these Terms on behalf of a company, organization, venue, client, or other person, you represent that you have authority to bind that party. You remain responsible for information, instructions, and commitments you provide.
- Website Information
The website provides general information about Wicked Chefs, our menus, and our services. Website content does not constitute a binding proposal, guarantee of availability, or reservation of an event date.
Menus, photographs, descriptions, serving presentations, and examples are illustrative. Ingredients, presentation, portions, equipment, and availability may vary based on the accepted proposal, season, market conditions, event size, venue, and service format.
We may update, correct, suspend, or remove website content at any time. We do not guarantee that every website item will be available for every event.
- Permitted Website Use
You may use the website only for lawful, personal, or legitimate business purposes related to Wicked Chefs.
You may not:
- Use the website for fraud, harassment, or unlawful activity;
- Submit false, misleading, or unauthorized information;
- Attempt to gain unauthorized access to the website or its systems;
- Introduce viruses, malware, or harmful code;
- Scrape, copy, reproduce, or commercially exploit website content without permission;
- Interfere with website operation or security;
- Impersonate another person or organization; or
- Use Wicked Chefs’ name, logo, photographs, menus, or content in a misleading manner.
We may restrict or block access when reasonably necessary to protect the website, our business, our clients, or others.
- Intellectual Property
The website and its content—including the Wicked Chefs name, logo, branding, menus, text, photographs, graphics, designs, and arrangement—are owned by or licensed to Wicked Chefs and are protected by applicable intellectual-property laws.
You may view and print website content for personal evaluation of our services. No other license or ownership right is granted.
Written permission is required before reproducing, publishing, modifying, distributing, selling, or commercially using our website content or branding.
- Inquiries, Proposals and Order Acceptance
Submitting an inquiry or contact form does not create a contract, reserve an event date, or obligate Wicked Chefs to provide services.
A proposal or estimate is valid only through its stated expiration date. Wicked Chefs may accept or decline an order based on availability, event requirements, service area, safety, payment status, venue conditions, licensing requirements, or other legitimate business considerations.
An order becomes confirmed only after all applicable requirements have been completed, including:
- Acceptance of the proposal or agreement;
- Receipt of the required deposit or reservation payment in cleared funds;
- Confirmation of the event date, location, menu, and service requirements; and
- Receipt of any other required documentation or information.
- Event-Date Reservations
An event date is not reserved merely because you requested a proposal, discussed an event, or received an invoice.
Until the required agreement and cleared deposit are received, the date may remain available to other clients.
If payment fails, is reversed, or is not received by the stated deadline, Wicked Chefs may release the date or suspend planning and preparation.
- Prices, Taxes and Charges
All prices are stated in United States dollars unless expressly stated otherwise.
The accepted proposal or invoice will identify applicable charges, which may include:
- Food and beverages;
- Delivery;
- Setup and pickup;
- Staffing and service hours;
- Rentals and equipment;
- Disposable items;
- Venue-related expenses;
- Parking and tolls;
- Service charges;
- Overtime; and
- Applicable taxes.
State and local taxes will be added where required. A service charge is not a gratuity unless the proposal or invoice expressly states otherwise.
Pricing may be revised when the client requests or approves changes to the guest count, menu, event time, delivery location, staffing, rentals, equipment, setup, or other requirements.
- Payment Terms
Deposits, reservation payments, installment amounts, and final-balance deadlines will be stated in the applicable proposal or invoice.
Unless Wicked Chefs agrees otherwise in writing:
- Deposits and reservation payments are nonrefundable;
- Payments must be made by the stated deadlines;
- The final balance must be paid before delivery or event service begins; and
- Payment is not complete until funds have cleared.
Failure to pay on time may result in suspension or cancellation of services. A cancellation caused by the client’s failure to pay will be treated as a client cancellation under the Refund and Cancellation Policy.
Payment methods, declined payments, third-party payments, processing fees, billing concerns, refunds, and chargebacks are governed by the Payment Policy.
- Final Guest Count
The client must provide a final guest count by the deadline stated in the proposal or event agreement.
Once confirmed, the final guest count will be used for purchasing, preparation, staffing, equipment, and billing. Charges will not be reduced because fewer guests attend.
If attendance exceeds the confirmed guest count, Wicked Chefs is not required to provide additional food, seating, equipment, or service. Additional charges may apply to any extra food or services that Wicked Chefs is able to provide.
- Menu Changes and Substitutions
Client-requested menu changes must be approved by Wicked Chefs in writing and may affect pricing, availability, and preparation.
Ingredients and menu items may become unavailable because of seasonality, supply interruption, quality concerns, market conditions, or circumstances outside our control. When reasonably necessary, Wicked Chefs may make a comparable substitution.
We will make reasonable efforts to notify the client of a material substitution and will not knowingly make a substitution that conflicts with a dietary restriction or allergy properly disclosed and accepted in writing.
- Cancellations, Rescheduling and Refunds
All cancellations and rescheduling requests must be submitted by email and are governed by:
- The accepted proposal or agreement;
- The Refund and Cancellation Policy; and
- Applicable law.
A cancellation or rescheduling request is not effective until received and acknowledged by Wicked Chefs in writing.
Because catering services require advance purchasing, preparation, staffing, scheduling, and vendor commitments, deposits and nonrecoverable expenses may remain nonrefundable.
- Delivery
Delivery availability, charges, timing, setup, recipient requirements, unsuccessful delivery, food-safety transfer, and equipment pickup are governed by the Delivery Policy and the accepted proposal.
The client must provide complete and accurate delivery information, including the venue name, address, room or suite, access instructions, parking information, security requirements, loading location, and an available on-site contact.
Wicked Chefs is not responsible for an unsuccessful delivery or delay caused by incorrect information, restricted access, unavailable recipients, venue procedures, traffic, weather, road closures, or circumstances outside our reasonable control.
- Setup, Breakdown and Pickup
Delivery does not automatically include buffet setup, display setup, chafing dishes, Sternos, serving utensils, disposable items, staffing, breakdown, cleanup, or post-event pickup.
These items or services are included only when specifically listed in the accepted proposal or order confirmation.
The client must provide sufficient access, tables, preparation areas, electricity, water, lighting, waste facilities, and other agreed site requirements.
- Client and Venue Responsibilities
The client is responsible for:
- Obtaining permission to hold the event at the venue;
- Providing accurate event and venue information;
- Coordinating venue access, parking, security, and loading;
- Obtaining permits assigned to the client under the proposal;
- Providing agreed utilities, tables, preparation areas, and facilities;
- Informing Wicked Chefs of venue rules and restrictions;
- Maintaining a safe environment for staff and guests;
- Supervising children and guests;
- Preventing unauthorized access to food and equipment;
- Communicating confirmed service details to the venue; and
- Paying charges resulting from client-requested changes or venue requirements.
Wicked Chefs is not responsible for delays, reduced service, or additional costs caused by venue restrictions or the client’s failure to satisfy these responsibilities.
- Staffing and Service Hours
Staffing is included only when expressly stated in the accepted proposal.
The proposal may identify the number and type of personnel, scheduled arrival and departure times, service responsibilities, and hourly or package pricing.
Staff members are not required to remain beyond the contracted service period. If additional service time is requested and personnel are available, overtime or extended-service charges may apply.
The client and guests must treat all Wicked Chefs staff members respectfully. Harassment, threats, discrimination, violence, illegal activity, or unsafe working conditions will not be tolerated.
- Rentals and Equipment
Rentals and reusable equipment may include chafing dishes, serving equipment, coolers, linens, tables, décor, display items, or other property identified in the proposal.
The client is responsible for protecting rented or reusable property after delivery and until pickup. Items must not be discarded, moved to an undisclosed location, misused, or released to an unauthorized person.
The client may be charged for property that is lost, stolen, damaged beyond ordinary wear, discarded, or unavailable at the scheduled pickup.
Third-party rental terms may also apply when disclosed in the proposal.
- Food Allergies and Dietary Restrictions
All allergies and dietary restrictions must be disclosed in writing before the menu and order are finalized.
Wicked Chefs will make reasonable efforts to follow dietary instructions that we have expressly accepted. However, our kitchen and food-service environments handle common allergens, including milk, eggs, fish, shellfish, tree nuts, peanuts, wheat, soy, and sesame.
Unless Wicked Chefs expressly confirms otherwise in writing, we cannot guarantee that any item is completely free from an allergen or cross-contact.
The client is responsible for communicating relevant information to guests and ensuring that guests with severe allergies make informed decisions about consuming catered food.
- Food Safety and Leftovers
Wicked Chefs transports, prepares, and serves food using appropriate food-safety practices.
For drop-off orders, responsibility for proper holding, serving, refrigeration, reheating, and storage transfers to the client or authorized recipient when delivery is accepted.
For staffed events, responsibility transfers to the client when the contracted service period ends or Wicked Chefs staff departs.
Hot food must be kept hot, cold food must be kept refrigerated, and perishable food should not remain at room temperature for more than two hours—or more than one hour when the surrounding temperature exceeds 90°F.
The client assumes responsibility for leftovers and food removed, stored, transported, reheated, or served after responsibility has transferred. Wicked Chefs is not responsible for food-quality or safety problems caused by improper handling after that transfer.
- Alcoholic Beverages
Alcoholic-beverage purchasing, delivery, bartending, or service is included only when expressly stated in the accepted proposal and legally permitted.
Unless the proposal assigns a responsibility to Wicked Chefs, the client and venue are responsible for obtaining required permissions, licenses, and permits concerning alcohol.
Wicked Chefs and its personnel may refuse alcoholic-beverage service to any person who:
- Is under the legal drinking age;
- Cannot provide acceptable identification;
- Appears intoxicated;
- Behaves dangerously or disruptively; or
- Cannot legally be served.
The client is responsible for guest conduct and arranging safe transportation.
- Outdoor Events and Weather
The client must provide a suitable weather backup plan for outdoor events, including appropriate shelter, flooring, lighting, power, and protection for food, personnel, and equipment.
Wicked Chefs may delay, modify, suspend, or stop service when weather or site conditions create an unreasonable risk to food safety, personnel, guests, or equipment.
Ordinary rain, unfavorable forecasts, or a client’s decision not to use an available backup location do not automatically qualify for a refund.
- Force Majeure
Neither party will be responsible for failure or delay caused by circumstances beyond reasonable control, including hurricanes, severe weather, natural disasters, fire, utility failure, government orders, public emergencies, transportation interruptions, labor disruptions, supply shortages, venue closures, epidemics, or similar events.
The parties will make reasonable efforts to reschedule when performance becomes unsafe, illegal, or impossible.
Amounts already spent or irrevocably committed for ingredients, staffing, rentals, transportation, supplies, and third-party services may remain nonrefundable. Any unused balance will be handled under the Refund and Cancellation Policy and applicable law.
- Safety and Right to Stop Service
Wicked Chefs may refuse, suspend, or stop service when reasonably necessary because of:
- Unsafe or unsanitary conditions;
- Threats, violence, or harassment;
- Illegal activity;
- Severe intoxication or disorderly conduct;
- Interference with food preparation or service;
- Dangerous weather;
- Lack of required utilities or facilities;
- Unauthorized access to equipment; or
- A material breach of the event agreement.
When service is stopped because of the client’s, venue’s, or guests’ conduct or unsafe conditions outside Wicked Chefs’ control, the client may remain responsible for all contracted charges and nonrecoverable expenses.
- Damage to Property
Each party is responsible for property damage directly caused by its own negligence, willful misconduct, or breach of the applicable agreement.
The client is responsible for damage caused by the client, guests, venue personnel, or vendors selected and controlled by the client.
Wicked Chefs is not responsible for preexisting damage or damage caused by venue conditions, guests, or unrelated third parties.
- Third-Party Vendors
Some events involve venues, rental providers, entertainers, planners, delivery services, or other independent parties.
Wicked Chefs is not responsible for the acts, omissions, delays, pricing, or performance of a vendor selected or directly contracted by the client.
When Wicked Chefs coordinates a third-party service identified in the proposal, the third party’s terms may also apply.
- Photographs, Reviews and Submitted Content
If you submit a review, testimonial, photograph, menu idea, or other content, you represent that:
- The content is accurate and lawful;
- You have the right to provide it;
- It does not infringe another person’s rights; and
- It does not contain malicious code or unlawful material.
You grant Wicked Chefs permission to use submitted information as reasonably necessary to respond to your inquiry and provide contracted services.
Wicked Chefs will use photographs, reviews, and testimonials for promotional purposes only as described in the Privacy Policy, an applicable event agreement, or other permission.
- Privacy
Our collection, use, retention, and disclosure of personal information are governed by the Wicked Chefs Privacy Policy.
If you provide personal information about guests or another person, you represent that you are authorized to provide it and have given any required notice.
- Third-Party Links and Services
Our website may link to payment providers, social-media platforms, venues, or other third-party websites.
Wicked Chefs does not control and is not responsible for third-party content, privacy practices, security, availability, or terms. Accessing a third-party website is at your own discretion and may subject you to that party’s terms.
- Disclaimer of Warranties
Wicked Chefs will provide contracted services substantially as described in the accepted agreement and in accordance with applicable law.
However, to the fullest extent permitted by law:
- The website is provided on an “as available” basis;
- Website access may occasionally be interrupted;
- Photographs and examples do not guarantee identical presentation;
- Taste and aesthetic preferences are subjective; and
- We disclaim implied warranties not expressly provided in the accepted agreement.
Nothing in these Terms excludes a warranty or consumer right that cannot legally be waived.
- Limitation of Liability
To the fullest extent permitted by law, Wicked Chefs will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost opportunities, or loss of enjoyment, arising from the website or contracted services.
To the fullest extent permitted by law, Wicked Chefs’ total liability arising from an order or event will not exceed the amount the client paid to Wicked Chefs for the specific products or services giving rise to the claim.
These limitations do not apply to liability that cannot legally be limited, including liability arising from gross negligence, willful misconduct, fraud, or personal injury or property damage to the extent caused by Wicked Chefs’ negligence and protected by applicable law.
- Indemnification
To the fullest extent permitted by law, the client agrees to defend, indemnify, and hold Wicked Chefs harmless from third-party claims, losses, or expenses arising from:
- The client’s breach of these Terms or an event agreement;
- False, incomplete, or inaccurate information provided by the client;
- Unsafe venue conditions controlled by the client or venue;
- Acts or omissions of the client, guests, or client-selected vendors;
- The client’s violation of law;
- Unauthorized content or personal information supplied by the client; or
- Damage to rented equipment caused by the client or guests.
This obligation does not apply to the extent a claim was caused by Wicked Chefs’ negligence, gross negligence, willful misconduct, or violation of law.
- Informal Dispute Resolution
Before filing a legal action, the client and Wicked Chefs agree to make a good-faith effort to resolve the dispute informally.
A written dispute notice should identify:
- The client and event;
- The disputed charge, service, or conduct;
- Relevant supporting information; and
- The requested resolution.
The notice must be emailed to chefsarini1@gmail.com. The parties will have 30 calendar days after receipt to attempt resolution, unless urgent relief is reasonably necessary or applicable law provides otherwise.
- Governing Law and Venue
These Terms and any dispute involving Wicked Chefs will be governed by the laws of the State of Florida, without regard to conflict-of-law rules.
Unless applicable consumer law requires otherwise, legal proceedings must be brought in a state or federal court with jurisdiction in Palm Beach County, Florida.
Nothing in these Terms prevents either party from bringing an eligible matter in small-claims court.
- Electronic Communications and Acceptance
You agree that proposals, agreements, invoices, notices, approvals, and other records may be provided and accepted electronically.
An electronic signature, electronic acceptance, email approval, or payment submitted after receiving the applicable documents may have the same effect as a handwritten signature where permitted by law.
You are responsible for providing an accurate email address and reviewing communications sent concerning your order or event.
- Changes to These Terms
Wicked Chefs may update these Terms periodically. The revised version will be posted on the website with an updated effective date.
Changes apply prospectively. They will not alter an already confirmed event agreement unless the parties agree in writing or applicable law requires otherwise.
- General Provisions
Entire Agreement
These Terms, the incorporated policies, the accepted proposal or agreement, applicable invoices, and approved written changes form the complete agreement concerning the applicable services.
Written Changes
A verbal statement does not modify an accepted agreement. Changes must be confirmed in writing by Wicked Chefs.
Severability
If any provision is found invalid or unenforceable, the remaining provisions will continue to the fullest extent permitted by law.
No Waiver
Failure to enforce a provision once does not waive the right to enforce it later.
Assignment
The client may not transfer an event agreement without written approval from Wicked Chefs. Wicked Chefs may assign an agreement as part of a lawful sale, merger, reorganization, or transfer of the business, subject to applicable law.

Section headings are provided for convenience and do not change the meaning of these Terms.
